Healthcare providers such as doctors, nurses, dietitians, physiotherapists and psychologists are healthcare staff under these terms and conditions.

THEHOSPITALONLINE.COM, which is a brand of Medicopin, LLC., through the SOFTWARE SYSTEM possessed by Medicopin, LLC., enables the members to communicate, in electronic media, with healthcare staff they have chosen through the system; and benefit of online medical advisory service.

THEHOSPITALONLINE.COM is global service provider, which, by means of its services, facilitates remote communication through digital system, between healthcare staff and the members, regardless of their location in the world. The healthcare staff with whom the member communicates may be located in any country and/or state other than that of the member who wishes to benefit of the advisory services. Each healthcare staff personnel chosen through the system is licensed in their own country and/or state; and operates in accordance with local health regulations and legislation. It is recommended that, before choosing the healthcare staff personnel through the system, the member examine the medical education and the branch of the personnel, and the country where he operates.

The service provided to the members by healthcare staff via remote communication is telemedicine service whereby general and advisory medical information is relayed. In provision of this service by THEHOSPITALONLINE.COM, the healthcare staff will not, orally or in written, have delivered to or recommended the member any results or treatment relating to his health condition. THEHOSPITALONLINE.COM does not guarantee in any way that remotely communicated healthcare staff will deliver advisory medical information which is pertinent and the suitable for the member’s medical status. It is entirely under the member’s initiative to benefit of online telemedicine service, or abide by the medical advisory information provided by healthcare staff.

Online telemedicine service which is provided to the member by the healthcare staff is not an alternative to physical examination. Therefore, in circumstances where the healthcare staff may find out, diagnose, treat or assess critical points peculiar only to the member, based solely on physical examination, the member may not obtain anticipated benefit from the remote communication. The member must, therefore, be aware of this vital information; and apply to the nearest health institution he would prefer in his location for physical examination, if he thinks is necessary.

The healthcare staff will, during the remote communication, conduct assessment, only limited to the information as orally provided by the member, and as provided on the documents uploaded to the system, if any; due to which, the staff may not form complete, adequate or decisive opinion in respect of the member’s health status. Thus, the member who has read the explanations given multiple times and who has agreed to receive services may not, for any reason, claim any rights against THEHOSPITALONLINE.COM and healthcare staff, relying on the medical advises provided by the healthcare staff.

It is entirely under the member’s own initiative to request remote communication with healthcare staff over THEHOSPITALONLINE.COM system and maintain one which has commenced.

The general and private data which will be provided to healthcare staff by the member during the remote communication may neither be exported out of the system nor be disclosed to third parties in such a manner as that it will cause pecuniary and non-pecuniary damages, and infringe personal rights.

During and after the remote communication, the member may not tape audial or visual records of the communication, export it out of the system and disclose to third parties, in such a manner as that it will cause pecuniary and non-pecuniary damages, and infringe personnel rights, to the detriment of healthcare staff.

THE MEMBER WHO WISHES TO BENEFIT OF THE ADVISORY SERVICES ACCEPTS AND UNDERTAKES THAT ANY INFORMATION AND/OR DATA HE HAS PROVIDED IN RELATION TO THE MEDICAL ADVISORY SERVICES ARE GENUINE, ACCURATE AND UP-TO-DATE. FOR THE PURPOSES OF THE TERMS AND CONDITIONS SET OUT HEREIN, THE MISLEADING INFORMATION MEANS ANY INFORMATION WHICH HAS INTENTIONALLY OR NEGLIGENTLY OR UNKNOWINGLY BEEN PROVIDED BY ANY OF THE PARTIES, IN RELATION TO THE REMOTE COMMUNICATION, AND WHICH LEADS TO WRONGFUL DESCRIPTION AND/OR DETERMINATION OF ANY HEALTH CONDITION, AND/OR WHICH LEADS TO ANY LOSS OR DAMAGE. IN NO EVENT SHALL THEHOSPITALONLINE.COM BE LIABLE FOR ANY DAMAGES INCLUDING, WITHOUT LIMITATION, DAMAGES INCURRED DUE TO SERVICES PROVIDED VIA ITSELF AND/OR ITS SOLUTION PARTNERS, INCIDENTAL AND CONSEQUENTIAL DAMAGES, PERSONAL INJURY/WRONGFUL DEATH, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION, REGARDLESS OF WHETHER BASED JUST CAUSE AND WHETHER OR NOT THEHOSPITALONLINE.COM AND/OR ITS SOLUTION PARTNERS HAS WARNED ABOUT THE POSSIBILITY OF SUCH DAMAGES.

IT IS RECOMMENDED THAT THE MEMBER READ ALL EXPLANATIONS HEREIN BEFORE CHOOSING TO BENEFIT FROM THE SERVICES PROVIDED BY THEHOSPITALONLINE.COM. IN CHOOSING TO DO SO, THE MEMBER WILL HAVE UNDERSTOOD AND ACCEPTED THE SCOPE AND THE LIMITS OF THE SERVICES, AND THE POTENTIAL RISKS LIKELY TO ARISE.

2. CONSENT TO THE INFORMATION TO BE UPLOADED BY THE MEMBER TO THE SYSTEM

The member who wishes to benefit from consultancy services may, at his will, upload his health information, for instance, lab and test results or any other medical documents, to the system, for the purpose of sharing with the health staff, in the phase of making an appointment. In so doing, the member accepts to have explicitly consented to that the documents he has uploaded may be viewed, registered, arranged and classified by the employees of Medicopin LLC and THEHOSPITALONLINE.COM, its solution partners and the health staff.

In respect of the services provided via THEHOSPITALONLINE.COM, remote visual communications are not recorded. The documents which have been uploaded to the system for the purposes of remote communication, in the phase of making an appointment may be removed by the member at his will.

3. WARNINGS RELATED TO USE FOR MALICIOUS PURPOSE

Any use or attempted use of  THEHOSPITALONLINE.COM (i) for any unlawful, unauthorized, fraudulent or malicious purpose, or (ii) that could damage, disable, overburden, or impair any server, or the network(s) connected to any server, or (iii) interfere with any other party's use and enjoyment of the Website, or (iv) to gain unauthorized access to any other accounts, computer systems or networks connected to any server or systems through hacking, password mining or any other means, or (v) to access systems, data or information not intended by THEHOSPITALONLINE.COM to be made accessible to a user, or (vi) attempt to obtain any materials or information through any means not intentionally made available by THEHOSPITALONLINE.COM,  (vii) any use other than the business purpose for which it was intended, or  (viii) any kind of cyber-attack is prohibited. The member, however, acknowledges that disclosure of his information and/or data may be requested without his consent in the phase of disclosure and/or request thereof, in circumstances laid down below:

c) for victims of abuses, neglects, or domestic violence,

d) for health oversight activities,

e) for judicial and administrative proceedings,

THEHOSPITALONLINE.COM, be it in its knowledge or not, shall in no circumstances be liable for any loss or damages that may be incurred by the member due to any usage of his own account or password by others. However, the member may, in such case, be liable for any loss and damages incurred by THEHOSPITALONLINE.COM or third parties.

The member, therefore, agrees to (a) immediately notify THEHOSPITALONLINE.COM in written, of any unauthorized use of his account or any other breach of security of which he becomes aware, and (b) exit securely from his account at the end of each login.

9. CANCELLATION / REFUND POLICY

Thank you for your help to keep our functioning productive and effective. If the member is not able to attend a scheduled consultation with a healthcare professional or she / he needs to cancel the request for consultation and / or second opinion, we kindly remind that the member should contact the administration.

Timeless cancellations may jeopardize our ability to provide the medical assistance our members need to receive at the right time.

Cancellation Policy based on timing is at following;

• The Hospital Online provides its members with reminders through notifications via mobile apps and e-mails for further assistance. Remembering the appointment is the member’s own responsibility. The fact that the member has not received a reminder e-mail or notification does not provide any cancellation privilige for the consultation she / he does not attend. We do not provide any refund if the member does not attend the appointment which is approved by doctor or the healthcare professional and finalised.
• If the doctor or healthcare professional does not approve your consultation request because the medical question you ask is not in his / her area of expertise or for any other reason, there will be no decrease in the number of call right in your package.
• If the doctor or the healthcare professional cannot attend the appointment, there will be no decrease in your package and a new appointment will be planned as soon as possible.
• If our members who purchased a single consultation do not prefer a make-up call, they can use their right on a different consultation or they can request a refund.
• If the member cancels the appointment 24 hours before the appointment, the right will be reserved. Our members who purchased a single consultation can use their right on a different doctor or a healthcare professional.

10. RESCHEDULING

The member will be permitted to reschedule an appointment with the same healthcare staff personnel only twice, within 48 hours prior to your appointment date.  The healthcare staff associated with THEHOSPITALONLINE.COM have the right to reschedule an appointment at all times.

11. LINKS TO THIRD PARTY WEBSITES

THEHOSPITALONLINE.COM may contain hyperlinks to other sites owned and operated by parties other than THEHOSPITALONLINE.COM. Such hyperlinks are provided only for ready reference and ease of use. THEHOSPITALONLINE.COM is not responsible for endorsing the content of these sites unless specifically so stated.
